Additional Terms of Use for Participation in Dassault Systemes SolidWorks Corporation Community Sites
Welcome to the Dassault Systemes SolidWorks Corporation (“DS SolidWorks”) Community Sites. DS SolidWorks provides the Community Sites subject to the Terms of Use for the DS SolidWorks website as well as these CommunityTerms of Use (collectively, “these Terms of Use”). By accessing, viewing, using, and/or downloading materials from the DS SolidWorks Community Sites, you agree to be bound by these Terms of Use; if you do not comply with these Terms of Use, DS SolidWorks reserves the right to terminate your authorization to access or use the Community Sites.
DS SolidWorks may at any time, without notice to you, revise these Terms of Use by updating this posting. Any changes will be posted here. We encourage you to review these Terms of Use from time to time since, by your continued access to or use of the DS SolidWorks Community sites; you will be bound by any such revisions.
SUBMITTED COMMENTS. Responsibility for Submissions and Legal Compliance. You are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), that you submit to the DS SolidWorks Community Sites. You represent and warrant that Content submitted by you will not (i) be libelous, obscene, excessively violent, scandalous, or defamatory, (ii) contain viruses or other contaminating or destructive features, (iii) violate the personal, propierty or intellectual property rights, such as copyrights, of any third party, or (iv) violate the Community Acceptable Use Policy set forth herein. You retain copyright and any other rights you already hold in Content that you submit to the DS SolidWorks Community Sites. By submitting your Content you give DS SolidWorks a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display, and distribute any Content that you submit to the DS SolidWorks Community Sites.
Use of Content Posted by Participants. By using the DS SolidWorks Community Sites, you acknowledge that (i) DS SolidWorks may not pre-screen Content and, as such, DS SolidWorks does not guarantee the accuracy, integrity, or quality of such Content, (ii) you will evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content’ (iii) you may be exposed to Content that is indecent, offensive, or otherwise objectionable, and (iv) under no circumstances will DS SolidWorks be liable in any way for any Content posted by participants in the DS SolidWorks Community Sites, including, but not limited to, any errors or omissions in any such Content, or for any loss or damages or any kind incurred as a result of the use of any such Content.
Right to Remove or Disable Access. If DS SolidWorks is made aware of Content that may be (i) libelous, obscene, excessively violent, scandalous, defamatory, or that SolidWorks determines in its sole discretion to be otherwise unacceptable, undesirable, or objectionable, (ii) a violation of any law, regulation, or rights of a third party, including, but not limited to, rights under the copyright law and prohibitions on libel, slander, and invasion of privacy, or (iii) a violation of the Community Acceptable Use Policy, DS SolidWorks has the right, but not the obligation, to remove or disable access to such Content.
COPYRIGHT INFRINGEMENT AND COPYRIGHT AGENT DS SolidWorks will, in circumstances it deems appropriate, terminate a participant’s right to participate in the Community Sites, and/or remove or disable access to Content, if such Content is claimed and appears to infringe the intellectual property rights of a third party.
If you believe that your work has been used or copied in a way that constitutes copyright infringement and such infringement is occurring on a DS SolidWorks community website, please provide notice to the DS SolidWorks Copyright Agent including the following information:
- A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest that is alleged to have been infringed.
- A description of the copyrighted work or works that you claim have been infringed and identification of what material in such work(s) is claimed to be infringing and which you request to be removed or access to which is to be disabled.
- A description of where the material that you claim is infringing is located on the DS SolidWorks Community Sites.
- Information sufficient to permit DS SolidWorks to contact you, such as your physical address, telephone number, and email address.
- A statement by you that you have a good faith belief that the use of the material identified in your Notice in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement by you that the information in your Notice is accurate and, under penalty of perjury that you are the copyright owner or authorized to act on the copyright owner's behalf.

YOU SHOULD CONTACT THE COPYRIGHT AGENT ONLY IF YOU BELIEVE THAT YOUR WORK HAS BEEN USED OR COPIED IN A WAY THAT CONSTITUTES COPYRIGHT INFRINGEMENT AND THAT SUCH INFRINGEMENT IS OCCURRING ON A DS SOLIDWORKS COMMUNITY SITE. THE COPYRIGHT AGENT WILL NOT RESPOND TO ANY OTHER INQUIRIES.
GENERAL PRACTICES REGARDING USE AND STORAGE. You are responsible for creating back-up copies of any Content you submit to the Community Sites that you may want to access in the future. DS SolidWorks will use commercially reasonable efforts to prevent the loss of or damage to Content submitted to the Community Sites and will maintain commercially reasonable back-up procedures and copies solely to facilitate the reconstruction of any Content that may be lost or damaged by DS SolidWorks in the event that, despite your best efforts, you are unable to reconstruct such Content using your own back-up and restore procedures or other copies.
INDEMNITY. You agree to defend, indemnify and hold DS SolidWorks and its affiliates, and their officers, employees, and contractors harmless from and against any claim, action or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of any Content you submit, post to, or transmit through a DS SolidWorks Community Site, your participation in the use of a Community Site, your violation of these Terms of Use, or your violation of any rights of another.
INTERNATIONAL USE. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content.
TERMINATION. DS SolidWorks reserves the right to discontinue access to one or more of its Community Sites to any person that does not comply with the Community Acceptable Use terms or these Community Terms of Use, as solely determined by DS SolidWorks. Moreover, a user may be denied access to DS SolidWorks Community Sites for behavior or content not suitable for the SolidWorks community, as solely determined by DS SolidWorks. Termination of your right to access or use the DS SolidWorks Community Sites is in addition to all other legal or equitable remedies available to DS SolidWorks.
